TERMS AND CONDITIONS
I acknowledge that I may use this online portal only if I am either (i) a prospective tenant submitting an application for approval to enter into a lease agreement with a property managed by Pelican Management, Inc. DBA Goldfarb Properties (“Pelican”), or (ii) a current tenant named on a lease agreement, with a property managed by Pelican; and have agreed to participate in this online portal by properly registering in accordance with these terms and conditions.
I acknowledge that I may use this online portal only if I am either (i) a prospective tenant submitting an application for approval to enter into a lease agreement with a property managed by Pelican Management, Inc. DBA Goldfarb Properties (“Pelican”), or (ii) a current tenant named on a lease agreement, with a property managed by Pelican; and have agreed to participate in this online portal by properly registering in accordance with these terms and conditions.
Fees Non-Refundable
ALL APPLICATIONS FEES ARE NON-REFUNDABLE (WHETHER OR NOT THIS APPLICATION IS APPROVED).
Availability
Even if this Application is approved, there will be no lease agreement unless and until a lease and related documents have been fully signed and delivered by all parties.
Misrepresentations
I certify that each of the statements made as part of this Application are true, accurate and complete in all aspects. If I intentionally make any representations or omissions of material fact in this Application that I know to be false or incorrect and that are intended to deceive or mislead, this Application shall be automatically denied (without refund of the application fee) and Applicant shall be barred from submitting any subsequent applications for approval in any property managed by Pelican.
Legal Capacity
I am at least 18 years old and have legal capacity to be bound by these Terms and Conditions.
Credit History and Other Information
As agent for the landlord, Pelican is authorized to periodically obtain a credit history and other information about me (including employment, income and asset information and any criminal history) through its own investigation and from the investigation of others.
Approval
Application approval is at landlords discretion to the extent that:
Pelican is firmly committed to the goal of fair housing. It is Pelican’s policy and practice not to engage in or assist the efforts of others to engage in housing discrimination including refusing to show, rent, negotiate for the rental of, or otherwise make unavailable or deny, apartments to any person because of their race, color, religion, sex or gender, familial status having or expecting a child under 18, national origin, disability, marital status, domestic partnership status, age, sexual orientation, alienage or citizenship status, lawful occupation, lawful source of income, or military status each a “prohibited basis”. Discriminate against any person in the terms, conditions or privileges of rental or in the provision of services or facilities. Make any verbal or written statement or inquiry with respect to the rental of apartments that indicates any preference, limitation or discrimination concerning a prohibited basis, or any statement indicating an intention to make any such preference, limitation or discrimination, including inquiring about a person’s religion and making statements regarding the race or religion of residents in apartments buildings or neighborhoods. Represent to any person because of a prohibited basis that any apartment is not available for inspection or rental when such apartment is in fact available. Discriminate against any person in offering individual apartment units or in assigning persons to such units because of a prohibited basis. Enter into an agreement that imposes any restriction upon persons to whom rental housing may be shown or rented because of a prohibited basis. Direct or steer any individual away from or toward a particular building, neighborhood or vacancy because of a prohibited basis. Coerce, intimidate, threaten or interfere with any person who is a prospective tenant or current tenant or anyone assisting a prospective tenant or current tenant to exercise or enjoy the rights guaranteed by the federal Fair Housing Act and state and local fair housing laws.
Fair Credit Reporting Act Notice
Pelican has disclosed to me that the investigation described above may include requesting a credit report which would investigate my character, general reputation, personal characteristics and mode of living. Pelican has advised me that I have the right to request, within a reasonable period of time after I sign this Application, a complete and accurate disclosure of the nature and scope of the investigation requested as well as a written summary of the rights of the consumer prepared pursuant to section 609(c) of the Fair Credit Reporting Act.
NOTICE UNDER NYCAC 20-809
The application information provided by you may be used to obtain a tenant screening report;
Pursuant to federal, state, and local law:
1. If we take adverse action against you on the basis of information contained in a tenant screening report, we must notify you that such action was taken and supply you with the name and address of the consumer reporting agency that provided the tenant screening report on the basis of which such action was taken;
2. If any adverse action is taken against you based on information contained in a tenant screening report, you have the right to inspect and receive a free copy of that report by contacting the consumer reporting agency; 3. Every tenant or prospective tenant is entitled to one free tenant screening report from each national consumer reporting agency annually, in addition to a credit report that should be obtained from www.annualcreditreport.com; and
4. Every tenant or prospective tenant may dispute inaccurate or incorrect information contained in a tenant screening report directly with the consumer reporting agency.
The applicant above certifies that each of the statements made as part of this application are true, accurate and complete in all aspects. Furthermore, each of the undersigned hereby authorizes you as agent for the prospective landlord to procure any credit or bank information needed by you to complete your review of this application. In the event you are dissatisfied with either my credit or banking verifications, or otherwise shall refuse to sign a lease, both you and the undersigned shall be deemed released from any further obligations or liabilities in connection with this application.
I understand that a non-refundable fee is required with this application. Furthermore, in the event a future Landlord-Tenant relationship exists between the parties, Tenant consents to periodic checks to determine whether the information remains accurate.
Payment Processing
I acknowledge that any payments made by anyone other than the named tenant on the lease or prospective tenant will not convey any tenancy rights to such payer.
I hereby authorize Pelican to electronically withdraw from my bank account the above amount as payment toward the outstanding balance due for my rent or towards an application fee.
I understand that by providing Pelican with the account number, routing number, and check number, I authorize Pelican to withdraw funds in the amount I have agreed upon.
Should the agreed upon withdrawal date fall on a Saturday, Sunday, or legal holiday, the payment will be withdrawn from my account on the first or second business day thereafter. I acknowledge that all automatic withdrawals will be ACH Transactions and must comply with the provisions of U.S. law.
I agree to provide all necessary authorization to my financial institution to allow the agreed payment to be withdrawn from my account. I understand that I am responsible for obtaining all information regarding my financial institution’s procedure for authorizing automatic withdrawals, including, but not limited to, discovering and paying any fees associated with such authorization.
I agree that Pelican shall not be responsible for any fees charged by my financial institution in connection with this electronic withdrawal and that any such fees shall have no effect on the outstanding balance being collected. I understand that if the automatic withdrawal is rejected by my financial institution, due to insufficient funds or other circumstances, Pelican may, but is not required to, attempt to resubmit the automatic withdrawal. Any automatic withdrawal not honored by my financial institution will be considered not paid and could subject to me to additional fees.
I acknowledge that this website is hosted by Yardi Systems, Inc., and I am bound by all of their terms and conditions.
